Warranty & Terms & Conditions

Pinksome is pleased to offer our customers a 12 month warranty on jewellery purchased through us. This warranty is available only on all jewellery sold directly through the our website, with the following conditions applicable. The 12 month warranty is from the date the customer receives the product for the first time and signs for the product. Pinksome will cover the cost of repair on any piece of jewellery that is still under warranty only for defects in materials, manufacturing and workmanship. Pinksome may instead of repairing replace the product with a new one.

This warranty is void if the damage is caused by excessive wear and tear. This includes showering, playing sports or swimming. Jewellery should not be exposed to hot, salt and chlorinated water, steam, make-up, perfumes, detergents, cleaning agents or other chemicals. Repairs, including re-sizing performed by parties other than Pinksome will also void this warranty. If a defect is discovered within the period of the warranty, the jewellery must be returned to Pinksome for inspection. Pinksome alone will determine if the defect is due to normal wear and tear or extraordinary circumstances. All returns will be inspected by our jewellers to ensure the item meets warranty terms and conditions. If it is determined that the jewellery has been damaged outside the bounds of the warranty, due to unusual or extreme wear or use, the customer will be held liable to pay for all repairs, as well as any shipping or insurance costs incurred. Pinksome will report to the customer in such instances. Repairs under warranty will be shipped free of charge. Pinksome is not liable for expenses, damage or loss incurred while the item is in transit from the customer to Pinksome. Pinksome will not be liable for damage to any chains that break on pendants, necklaces, and bracelets and will not be held liable for damage to ear-backs, nose rings, or other body jewellery due to the nature of the type of jewellery.

The warranty does not cover loss or theft of the jewellery in part or its entirety.

RING RE-SIZING

Pinksome will re-size a ring one time free of charge, within the warranty period under the conditions that the ring is sent to Pinksome for re-sizing or is resized at an Pinksome authorised service centre. This one-time free re-size will only apply to shanks with no diamonds set on the lower half the shank and will not apply to shanks set with diamonds in their entirety.  Pinksome in their discretion will determine if a ring is resizable. Resizing requested beyond this one time offer is chargeable and the cost will be determined by Pinksome and reported back to the customer. Any ring resized by a 3rd party without the authorization of Pinksome, will automatically void the warranty, and Pinksome will not be responsible for any costs or damages incurred.

Customer Terms (“Terms”)
These Terms and any document(s) referred to in them constitute the entire agreement about Pinksome Designs supply of the Products and services to Customer and supersedes all prior understandings, arrangements and agreements. 
Words with special meanings are defined in clause 1. A reference in these Terms to:

the singular includes the plural and vice versa;
the word “including” means “including, but not limited to,” and the word “includes” means “includes, without limitation,”;
A reference to a gender includes all genders; and
A reference to a person (including a party) includes an individual, company, other body corporate, partnership, firm, joint venture, or a trust.

1) Definitions
In these terms:
“Customer” means the person, business or company that is the purchaser of the Products;
“Products” means any products or services (where applicable) supplied to Customer by Pinksome Desiogns and described in Pinksome’s invoice;
“Pinksome” means Pinksome Designs(ABN).  

2) On-line Orders

All on-line orders for Products placed by Customer are subject to acceptance by Pinksome, and no order will be deemed to have been accepted by Pinksome unless Products are supplied or a back-order or delivery delay is confirmed in writing and signed by an authorised representative of Pinksome to Customer. Pinksome may reject any order placed by Customer if there is an insufficient supply of Products which prevents Pinksome from being able to fulfil such order. Pinksome may reject any order placed by Customer for any reason, including, but not limited to incorrect pricing due to typographical errors, market factors or manufacturer price changes. Pricing is not retrospective. Upon acceptance of Customer’s order, the price charged to Customer is the price that is shown at the Pinksome Website checkout or agreed upon by Customer at the time the order was placed. Pinksome will not be bound by any terms attaching to Customer’s order and, unless those terms are expressly agreed to in writing by an authorised representative of Pinksome, Customer agrees that those terms are hereby excluded.

3) Payment

The price of the Products will be Pinksome’s website price. Payments can be made credit cards and if available other methods such as Paypal, direct deposit, Zipmoney or as advised by Pinksome 

4) Delivery & Shipping
Delivery times advised to Customer are estimates only and Pinksome will not be liable for any loss, damage or delay suffered or incurred by Customer or its customers arising from late or non-delivery of the Products. Delivery is usually by a method that requires a signature. By selecting for us to deliver an order to you, you agree that we have satisfied the delivery requirement where a signature has been received from the recipient, appropriate agent or proxy recipient of the order (chosen at the courier partner’s discretion). This includes, but is not limited to, a hotel or office receptionist signing on receipt of delivery at the specified address. You agree that in doing so we have delivered the order within the terms of the agreement between you and us. Domestic shipping to all Australian addresses is FREE. No minimum amount or quantity purchase required. All domestic purchases will be shipped free of charge. Almost in most cases you will receive a tracking number to track your delivery. We use Australia Post services on all our deliveries. International orders will be shipped via Australia Post Express Courier International and incur a nominal admin fee of AU$30. The purchaser and/or recipient of the items must comply with all laws and regulations of the destination country. All customs duties, excise if applicable, local taxes and other charges are payable by the recipient of the items. Once the items have been delivered to the common carrier in your country title and risk of loss for items will transfer to you, the recipient unless additional insurance has been purchased. All our orders are dispatched with tracking number. This number will be passed on to you once the order is shipped. Almost in all cases a signature will be required. Please have someone present at the nominated address to accept the package. Pinksome may make part deliveries of any order, and each part delivery will constitute a separate supply of the Products upon these Terms. 

5) Returns and refunds
Returns and refunds will be subject to Pinksome’s returns policy as advised to Customer and amended by Pinksome from time to time, the current version of which is set out on Pinksome Website. Pinksome will not be liable for any damage or defects in the Products that have been caused by the improper storage or by neglect, abuse or improper use. The provisions of this clause do not extend to any Products which have been added to, varied, or otherwise modified by, any person other than Pinksome.

You may return any piece of jewellery that has not been worn, scratched, tampered with, damaged or broken within 30 days of purchase. To return an item you need to contact us and obtain a RAN (return authorisation number). Returns must be accompanied with the RAN, proof of purchase and be in its original condition, include the attached price tags and original packaging as received. It is important to note that any piece of jewellery that has been worn will not be accepted under our terms and conditions.

If our jewellers find that the item has been worn, altered, scratched or has sustained physical or chemical damage (from make-up, detergents, swimming pools etc.) refunds will not be processed and the item will be returned to the purchaser. Refunds may take up to 3 weeks but usually are processed within 5 working days. The banks may take up to 7 working days to credit your card with the refund amount. All refunds will be processed in the same currency as original purchase.

If the item shipped is an incorrect item or been damaged within the first 30 days of purchase and is faulty please complete the returns form here to obtain RAN and send the item to us. You may also request a replacement instead of a refund. All returns will be inspected by our jewellers to ensure the item meets warranty terms and conditions and refunds criteria. If our jewellers find that the item has been altered, scratched or has sustained physical or chemical damage (from make-up, detergents, swimming pools etc.) refunds will not be processed and our warranty terms and conditions apply. Pinksome Designs is committed to provide safe and secure shopping and browsing experience and we are committed to protecting your privacy. Your information is managed by us in accordance with the Privacy Act 1988 (”Privacy Act”). When we ask you to provide certain information by which you can be identified when using this website (such as account login etc.), than you can be assured that it will only be used in accordance with this privacy statement. We may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

Collection of your personal information

We collect your personal information only for fulfilling your order and we collect the information by lawful means. We use the information to provide you products and services as per your order/s. You will be aware when we collect information about you and what information we collect. You can also alter this information if incorrect and have access to the information. We are committed to ensuring that your browsing and your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.  Our entire website and not only checkout and your information is located in secure server (please see the https:// prefix in browser address). We offer high grade security. Your credit card information not only is not stored by us but we do not even see the information. 9) Termination

Notwithstanding any of these Terms and Conditions, Pinksome reserves the right, without notice and in its sole discretion, to terminate your use of this site, and to block or prevent future your access to and use of the Site .

10) Force majeure
If the performance of Pinksome’s obligations under these Terms is prevented, restricted or affected by force majeure including strike, lock out, raw material shortage, breakdown of plant, transport or equipment or any other cause beyond the reasonable control of PINKSOME, Pinksome will give notice of such cause to Customer and after 60 days from the receipt by Customer of such notice, either party may terminate the relevant Sales Contract without penalty. 

11) General

Pinksome may amend these Terms at any time, by giving Customer notice by mail, e-mail or by posting a notice on Pinksome’s public website. By continuing to place orders for Products, Customer will be deemed to have accepted the revised Terms. By using this site, you agree to be bound by these terms and conditions. These Terms and Conditions govern your use of, and any purchase from, the Pinksome’s website, and constitute an agreement between you and Pinksome. Pinksome reserves the right to change or modify any of these Terms and Conditions or any policy or guideline of the Site at any time, and in its sole discretion. Any change or modification will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of its changes or modifications will constitute your acceptance of such changes or modifications. Whilst Pinksome shall use reasonable endeavours to ensure the integrity and security of the Server, Pinksome does not guarantee that the Server will be free from unauthorised users or hackers. Pinksome does not warrant whatsoever that Pinksome virus protection services will stop every virus from reaching the Customer’s computer network. Pinksome makes no warranty that the service will be error free or free from interruption or failure, and Pinksome expressly excludes any express or implied warranty regarding system and/or service availability, accessibility, or performance. Any provision of these Terms which is invalid or unenforceable will be read down to the extent necessary, and the remaining provisions will continue unaffected. These Terms are governed by the laws of the State of New South Wales and the courts of the state of New South Wales shall have exclusive jurisdiction to hear any disputes arising from or relating to this agreement.
